Definitions and Interpretation
In these Terms, unless the context requires otherwise:
- "Client", "you", "your" means the person who makes a Booking and every traveller named in it. The person making the Booking (the "Lead Client") confirms that they are authorised to accept these Terms on behalf of all travellers named in the Booking and is responsible for payments due under it.
- "Booking" means a reservation for any Services made with or through Indian Holidays that has been confirmed in accordance with Clause 1.5.
- "Services" means the travel services we arrange, including domestic, inbound and outbound (international) tour packages, hotel and other accommodation, flights, rail/bus tickets, transfers, car/coach hire, sightseeing, guides, visa guidance and assistance, cruises, houseboats and shikaras, wildlife safaris, adventure activities and any related services.
- "Supplier/hotel" means any independent third party that actually provides a Service, including hotels, resorts, homestays, airlines, railways, cruise lines, houseboat and shikara operators, transport operators, cab/coach owners, drivers, guides, safari operators and park/forest authorities, adventure operators, ground handlers/destination management companies (DMCs), insurers, visa processing centres and embassies/consulates.
- "Domestic" Services means travel within India for clients resident in India; "Inbound" Services means travel within India for foreign nationals, NRIs/OCI cardholders or other clients paying from outside India; and "Outbound" Services means travel from India to destinations outside India. Where a clause applies only to one of these, it says so; otherwise it applies to all three.
- "Total Price" means the total amount payable for a Booking as shown in our Quotation/Booking confirmation (as updated by any change notified to you in writing under these Terms), including applicable taxes and government levies. Tax collected at source ("TCS"), where applicable, is shown and collected separately and is not part of the Total Price.
- "Arrival" / "Date of Arrival" means the first date of Services in the Booking (for example the first hotel check-in or the start date of the tour).
- "Quotation" means our written quotation/proposal for the Services, including its inclusions, exclusions, payment terms and any tour- or supplier/hotel-specific conditions.
- "Working day" means a day other than a Sunday or a public holiday in Haryana on which banks in Gurugram are open for business.
- Headings are for convenience only. "Including" means "including without limitation". Words in the singular include the plural and vice versa.
- Order of precedence: if there is any conflict, the following prevail in this order: (a) the specific tour- or supplier/hotel-specific conditions disclosed to you in writing before you pay the initial advance; (b) the Quotation/Booking confirmation; (c) these General Terms & Conditions; (d) any general information on our website or brochures. Nothing in (a) or (b) limits Clause 7.7 (non-excludable rights) or Clause 9.5 (consumer rights).
1. Scope of Services & Booking Confirmation
1.1 Our role. Indian Holidays arranges travel services that are provided by independent third-party suppliers/hotels. We do not own, operate or control any hotel, airline, vehicle, vessel, safari, adventure activity or other facility used in providing the Services, unless we expressly state otherwise in writing for a specific Service. Where you book a single Service (for example a hotel room or a flight only), we act as a booking agent for the supplier/hotel. Where we design and sell a combined tour package, we are responsible for exercising reasonable skill and care in planning the package, in selecting reputable suppliers/hotels, and in making and managing the arrangements we have agreed to make. The suppliers/hotels remain responsible for providing their own Services (see Clause 7).
1.2 Services covered. These Terms apply to all Services we arrange, including:
- domestic, inbound and outbound (international) tour packages;
- hotel and other accommodation bookings;
- domestic and international flight bookings;
- airport/railway transfers, car and coach hire, and sightseeing;
- visa guidance and assistance, against a service charge (see Clause 6.2);
- facilitating overseas travel insurance through Asego (see Clause 8.2);
- cruises, houseboats and shikaras;
- wildlife safaris, trekking and adventure activities arranged through specialist suppliers.
1.3 Supplier/hotel terms. Each Service is also subject to the terms and conditions of the relevant supplier/hotel (including airline conditions of carriage, hotel policies, cruise ticket contracts and park/forest authority rules). Those terms may limit or exclude the supplier/hotel's liability. We will make material supplier/hotel conditions (in particular cancellation, amendment and non-refundability conditions) available to you before you pay the initial advance.
1.4 Quotations. A Quotation is an invitation to book and is not a confirmed reservation. Unless stated otherwise, it is valid for the period stated on it and is subject to availability at the time of booking. Hotels, flights and other Services shown as "proposed", "similar" or "on request" are not confirmed until expressly confirmed in writing in accordance with Clause 1.5A. Sending us an enquiry (including through our website enquiry form) does not create a Booking and does not by itself bind you to these Terms.
1.5 Booking process and confirmation. A Booking is confirmed only when all of the following have occurred:
- (a) you have accepted the Quotation in writing (including by email or WhatsApp from your registered number);
- (b) we have received the initial advance (and full payment for any flights and other non-refundable items) in cleared funds in our account;
- (c) we have received the documents and details we need (for example names exactly as in passport, dates of birth, nationality, passport details and PAN where required); and
- (d) we have issued a written Booking confirmation.
Until confirmation, prices and availability are not guaranteed, and we will refund any amount received for a Booking that we are unable to confirm, less only non-refundable amounts that you specifically instructed us to pay before confirmation.
1.5A Confirmation of individual Services. Our Booking confirmation confirms our agreement to arrange the Services listed in it. Availability of each individual hotel, flight or other Service is guaranteed only when the relevant supplier/hotel has confirmed it and we have passed that confirmation to you in writing (for example a hotel confirmation number, an airline e-ticket/PNR, or a service voucher). We will request supplier/hotel confirmations promptly after the Booking is confirmed and will tell you if any Service cannot be confirmed. In that case we will offer you an alternative of a similar standard (with any price difference explained to you before you accept it) or, if you do not accept the alternative, a refund of the amount you paid for that Service, less only amounts that you specifically instructed us to pay on a non-refundable basis. If the unconfirmed Service is a significant part of the Booking, Clause 5.1 applies.
1.6 Acceptance of these Terms. By accepting a Quotation, making any payment, or using any Service, you confirm that you have read, understood and accepted these Terms, the inclusions/exclusions, and the applicable tour- and supplier/hotel-specific conditions on behalf of yourself and all travellers in your Booking.
1.7 Accuracy of details. You must check the Booking confirmation, tickets, vouchers and itinerary as soon as you receive them and tell us immediately of any error. Names must match passports/government ID exactly; airlines and some suppliers/hotels charge for, or refuse, corrections. We are not responsible for costs arising from inaccurate information supplied by you. We will correct any error that is our own at no charge to you and without any additional handling fee.
1.8 Inclusions and exclusions. Only Services expressly listed as "inclusions" in the Booking confirmation are included. Unless expressly included, the price does not include: airfare, visa fees, travel insurance, meals not specified, personal expenses (laundry, telephone, minibar, tips), optional activities, camera/entry fees, porterage, early check-in/late check-out, and costs arising from delays or events outside our control.
1.9 Special requests. Requests (for example adjoining rooms, bed type, high floor, dietary needs, honeymoon set-ups) will be passed on to the relevant supplier/hotel but cannot be guaranteed unless confirmed in writing as a paid inclusion.
1.10 Hotel classifications, descriptions and policies. Star ratings and descriptions are those given by the supplier/hotel or local authorities and may differ between countries. Hotel policies vary by property and destination, including check-in and check-out times (commonly around 2:00 PM check-in and 12 noon check-out, local time), identity-document requirements, age limits, extra-bed and child policies, deposits and local taxes payable at the hotel. We will tell you of any material hotel policy that we are aware of before you pay the initial advance; otherwise each hotel's own policy applies.
2. Tariff, Currency Rates & Tax Adjustments
2.1 Prices. The Total Price for your Booking is shown in the Quotation and Booking confirmation. Prices are quoted per person or per Booking as stated in the Quotation.
2.2 Taxes and government levies. Quotations and invoices will reflect applicable taxes, government levies and other charges in accordance with the laws in force. Where a change in statutory taxes or government levies affects your Booking, we will inform you where relevant (see Clause 2.7). We will issue tax invoices as required by law, showing our GSTIN (06AIGPS2325C1ZM). If you need the invoice in the name of a GST-registered business, you must give us the correct GSTIN and legal name before invoicing.
2.3 TCS on overseas tour packages. Where tax collected at source ("TCS") applies under the income-tax law – for example, on the sale of an overseas tour programme package – we will collect TCS at the rate prescribed by the law in force on the date of collection. Whether TCS applies, and how much is collected, depends on the nature of the transaction and the statutory provisions then in force; it does not apply to every Booking (for example, it does not apply to domestic tours within India). If the law changes after your Quotation, the TCS shown in later payment requests and invoices will follow the law in force on the date of collection.
- (a) Where applicable, TCS is in addition to the Total Price and is shown separately in the Quotation and invoice.
- (b) TCS is a tax collected on behalf of the Government; it is not a fee or charge retained by Indian Holidays.
- (c) TCS is deposited against the PAN of the person in whose name the invoice is raised and reported as required by law. Credit for TCS may be available to that person in accordance with income-tax law, and we will issue any TCS certificate required by law.
- (d) Where TCS applies, its amount will be shown separately from the Total Price in every quotation, Booking confirmation, payment request or payment schedule, invoice and receipt, and in any cancellation or refund statement for the Booking.
- (e) TCS is not a service fee, handling charge or supplier/hotel charge. Our cancellation and service/handling charges are not calculated on TCS (see Clauses 4.3, 4.3A and 4.6).
2.4 PAN and other documents. For outbound packages, you must provide a valid PAN and any other document or declaration that is legally required for the Booking. If a valid or operative PAN is not provided where required, tax may have to be collected at a higher rate as prescribed by law.
2.5 Foreign exchange. Payments for outbound packages may involve foreign exchange remittances made through an authorised dealer bank in accordance with foreign exchange law. You agree to provide any declaration or document that we or the bank reasonably require for this purpose.
2.6 Currency conversion (outbound and other foreign-currency Services). Where any part of the Services is priced in a foreign currency, the Quotation converts it to Indian Rupees at the reference rate, which is the xe.com mid-market rate on the date of the Quotation plus INR 1 per unit of foreign currency (for example, if xe.com shows USD 1 = INR 84.00, we use INR 85.00). For each payment, the foreign-currency amount still unpaid will be recalculated on the same basis, using the xe.com mid-market rate on the date that payment is made plus INR 1 per unit. The method is symmetrical: if the Rupee has weakened, the Rupee amount of that payment goes up; if the Rupee has strengthened, it goes down, and the reduction is passed on to you in the same way as an increase. Amounts you have already paid are not recalculated. Bank charges for each payment are payable as set out in Clause 3.7. Rupee figures in a Quotation for foreign-currency components are therefore indicative until paid, and each payment request will show the xe.com rate, the reference rate used and the resulting Rupee amount.
Example (for illustration only). A Quotation includes a USD 1,000 hotel component. On the Quotation date xe.com shows USD 1 = INR 84.00, so the reference rate is INR 85.00 and the component is shown as INR 85,000. If USD 500 of it is still unpaid when the second instalment is due and xe.com then shows INR 85.50, that USD 500 is charged at INR 86.50 (INR 43,250). If xe.com instead shows INR 83.50, it is charged at INR 84.50 (INR 42,250).
2.6A Payments remitted from abroad (inbound clients). For clients paying from outside India, all bank charges are borne by the client, including the remitting bank's charges, any correspondent/intermediary bank charges and our Indian bank's inward remittance charges. Indian Holidays must receive the full quoted amount, clear of all bank charges, in our bank account. Remittances must therefore be sent on an "OUR" basis (all charges to the sender). A payment is treated as received only to the extent of the net amount credited to our account in Indian Rupees, at the conversion rate applied by our bank on the date of credit. Any shortfall caused by bank charges or exchange differences will be added to the next instalment or the final balance, and we will tell you the amount of any shortfall in writing. Card or payment gateway payments from abroad may carry an additional surcharge, which will be stated before payment.
2.7 Price changes before full payment. Until the Total Price has been paid in full, prices are subject to change due to:
- (a) exchange-rate fluctuations (applied to unpaid amounts as set out in Clause 2.6);
- (b) introduction of, or changes in, taxes, levies, tourism/city taxes, park/entry fees, permits or government charges;
- (c) fuel surcharges or fare changes imposed by airlines, cruise lines or transport operators;
- (d) supplier/hotel price changes, including peak season, festival, event or holiday supplements, and compulsory gala dinners.
How we notify you. We will notify you in writing of any change, with the reason, the amount of the change and supporting details from the supplier/hotel or authority where available.
The 10% threshold. If the increase in the Total Price (excluding changes in statutory taxes, TCS and exchange rates for unpaid amounts) exceeds 10% of the Total Price, you may cancel the Booking within 3 working days of our notice and receive a refund of amounts paid, less any non-refundable amounts already paid to suppliers/hotels with your written consent. For this purpose: (i) the increase is measured against the Total Price stated in the original Booking confirmation; (ii) all such increases notified to you are added together; and (iii) if you cancel under this paragraph, the cancellation charges in Clause 4.3 and the service/handling charges in Clause 4.3A do not apply. Instead of cancelling, you may accept the revised price or any alternative we offer. If you do not tell us within 3 working days, we will contact you before treating the revised price as accepted.
Exchange-rate and statutory changes. Changes in exchange rates and changes in statutory taxes or government levies are treated separately from the 10% threshold. They may be passed on to you even where the overall increase is below 10%, but only where: (i) the change actually applies to your Booking; (ii) for exchange rates, the change affects foreign-currency amounts not yet paid and is calculated as set out in Clause 2.6; and (iii) passing it on is permitted under your Booking and applicable law. We will show you how the additional amount has been calculated. Where an exchange-rate recalculation reduces the Rupee amount, the lower amount applies.
Increases at or below the threshold. Increases that do not exceed the threshold (or that are excluded from it) are payable as notified. If you choose to cancel because of such an increase, Clause 4 applies in the normal way.
After full payment. Once the Total Price is paid in full, we will not increase the price except for changes in statutory taxes or government levies that apply to the travel date.
2.8 Errors. We take care to quote correct prices. If there is an obvious error in a price, we will tell you as soon as we become aware of it and you may choose to proceed at the correct price or cancel with a full refund of amounts paid for the affected Service.
3. Payment Schedule, Advance Deposits & Gateway Surcharges
3.1 Standard payment schedule. Unless the Quotation states different terms, payments are due as follows:
| Stage | Amount | Due date |
|---|---|---|
| Initial advance | 40% of the Total Price | On confirmation of the Booking |
| Second instalment | 50% of the Total Price | 30 days before Date of Arrival |
| Balance | 10% of the Total Price | 7 working days before Date of Arrival |
Where TCS applies, it is collected with each payment as required by law.
3.2 Flights and non-refundable items. Flights, and any other Service that the supplier/hotel requires to be paid in full and/or that is non-refundable at the time of booking (for example certain promotional hotel rates, safari permits, cruises, event tickets and visa fees), must be paid in full at the time of booking, in addition to the initial advance for the remaining Services. We will identify these items in the Quotation.
3.3 Late bookings. If a Booking is made within 30 days of the Date of Arrival, the advance and second instalment (i.e. 90% of the Total Price) are payable on confirmation; if made within 7 working days of arrival, 100% of the Total Price is payable on confirmation.
3.4 Supplier/hotel-specific payment terms. Some suppliers/hotels (including those in peak season, festive periods, cruises, safaris and special events) require larger or earlier deposits. Any such terms will be set out in the Quotation, or otherwise disclosed to you in writing, before we confirm the Booking and before you make the payment concerned, and will then apply in place of the standard schedule. Where a supplier/hotel deadline means we need a payment earlier than the standard schedule, the Quotation will state the date by which we need it and what happens to the reservation if it is not received.
3.5 Failure to pay. If any instalment is not received in full by its due date, we will send you a written reminder. If payment is still not received within 2 working days of the reminder, we may treat the Booking as cancelled by you and apply the cancellation charges in Clause 4, and we will not be liable for any loss of reservation. Where a supplier/hotel may release a reservation earlier because of a missed payment, our reminder will say so.
3.6 Accepted payment methods. Payments may be made by bank transfer (NEFT/RTGS/IMPS), UPI, cheque/demand draft (subject to realisation), or debit/credit card or other payment-gateway methods we offer. Our website is for enquiries only; it does not take Bookings or payments. After you accept a Quotation, we will send you our bank details or a payment link by email or WhatsApp from our official contact details.
3.7 Bank charges and gateway surcharges.
- (a) All bank charges, inward/outward remittance charges, and currency conversion charges levied by your bank are payable by you.
- (b) Card and payment-gateway payments may carry a convenience fee or transaction charge levied by the payment gateway, bank or card network for processing your payment. Where it applies, its amount will be disclosed to you before you pay, so that you can choose another payment method. This charge is the actual cost of processing your payment; it is not a fee of Indian Holidays and is not part of the Total Price. If we charge any fee of our own in connection with a payment, it will be shown separately and described as our fee before you pay. Subject to applicable law: (i) gateway charges actually incurred will be refunded to you where Indian Holidays cancels the tour or Booking, or is responsible for the cancellation, and they will not be deducted from any refund that these Terms require to be a full refund (for example under Clauses 2.8, 4.13(b) and (c) and 5.1); and (ii) in all other cases, including where you cancel, gateway charges actually incurred are non-refundable, except where applicable law, regulation or payment-network rules require them to be refunded. We will not apply a charge to any payment method for which applicable law or payment-network rules prohibit it.
- (c) International cards may attract foreign transaction charges from your card issuer.
3.8 Cash payments. We do not accept cash payments at or above the limits prescribed under income-tax law. We may refuse cash entirely at our discretion. Any cash accepted will be acknowledged with a written receipt.
3.9 Payments only to our official accounts – fraud warning. Payments must be made only to the bank account(s)/UPI ID(s) printed on our official invoice or confirmed by us in writing from our official email or phone. We will never ask you to pay into a personal account of an employee, or change our bank details by WhatsApp or phone only. If you receive any request to pay into a different account, do not pay and verify by calling +91 98100 74368. Indian Holidays will not be responsible for any payment made to any account other than our official accounts.
3.10 Receipts. We will issue a receipt and/or tax invoice for every payment. Please retain them for your records and for any TCS credit claims.
3.11 Chargebacks. If you initiate a card chargeback for a Service that has been provided or for which the cancellation charges in Clause 4 apply, you agree to cooperate with us and the card issuer, and we reserve our right to recover undisputed amounts due.
4. Cancellation, Refund Rules & Non-Refundable Vendor Clauses
4.1 Our approach. Indian Holidays makes every effort to minimise cancellation charges, but we must adhere to the cancellation policy of each supplier/hotel. When you cancel, the amounts we may retain fall into three types, which are explained below and are never charged twice for the same loss or work:
- (a) Indian Holidays' own charges – the fixed service/handling charge in Clause 4.3A (where no part of the advance has been paid to suppliers/hotels), the handling fee included in the cancellation charge under Clause 4.3 (where amounts have been paid to suppliers/hotels), amendment fees under Clause 4.10, and our service charges for visa or other standalone services already performed;
- (b) supplier/hotel cancellation penalties and non-refundable amounts – amounts that a supplier/hotel retains or does not refund to us under its own conditions (see Clauses 4.4 and 4.5); and
- (c) supplier-refundable amounts – amounts paid to suppliers/hotels that they refund to us, which we pass on to you under Clause 4.7(b).
4.2 How to cancel. Cancellations must be made in writing by the Lead Client (by email to bookings@indianholidaystours.com or WhatsApp to +91 98100 74368). The cancellation takes effect on the date and time (IST) we receive it; requests received after 6:00 PM IST or on a non-working day are treated as received on the next working day. Verbal cancellations are not accepted. We will acknowledge your cancellation in writing.
4.3 General cancellation charges (where amounts have been paid to suppliers/hotels). Subject to Clause 4.3A, and unless stricter tour- or supplier/hotel-specific conditions have been disclosed to you (see Clause 4.4), the following charges apply as a percentage of the Total Price (excluding any TCS):
| When we receive your written cancellation | Cancellation charge |
|---|---|
| From booking up to 31 days before Date of Arrival | 10% of the Total Price |
| 30 to 21 days before Date of Arrival | 50% of the Total Price |
| 20 to 15 days before Date of Arrival | 75% of the Total Price |
| 14 days before Date of Arrival up to and including a no-show | 100% of the Total Price |
How the charge is calculated. The percentages in the table above are the maximum cancellation charge (the "slab amount"). Where Clause 4.3 applies, we retain:
- (i) the actual cancellation charges and non-refundable amounts of the suppliers/hotels for the cancelled Services, applied under their conditions disclosed to you (Clauses 4.4 and 4.5); plus
- (ii) Indian Holidays' handling fee for our work, at the per-adult and per-child rates in Clause 4.3A for the type of Booking, plus GST,
but the total of (i) and (ii) will not exceed the slab amount. If the actual supplier/hotel amounts in (i) alone are higher than the slab amount, we retain only those supplier/hotel amounts and no handling fee is added. Amounts that suppliers/hotels refund to us are passed on to you under Clause 4.7(b). Your refund statement (Clause 4.7) will show each part separately. The same cost or loss is never recovered twice.
Example (for illustration only). You cancel 25 days before the Date of Arrival, so the 50% slab applies, and the slab amount is INR 50,000. Actual supplier/hotel cancellation charges are INR 40,000 and the applicable handling fee is INR 5,000. The cancellation charge is INR 45,000 (INR 40,000 + INR 5,000), not INR 50,000. If the supplier/hotel charges were INR 52,000, the charge would be INR 52,000 only, provided those charges were disclosed to you under Clauses 4.4 and 4.5.
4.3A Service/handling charges. If you cancel a Booking after paying the advance and no part of that advance has yet been paid to any supplier/hotel, Indian Holidays has the right to deduct its service/handling charges from any refund due, for planning, reservations and processing already carried out, instead of the cancellation charges in Clause 4.3. The charges are calculated for each Booking according to the number of adults and children in it, at the following rates, unless a different amount is stated in the Quotation:
| Booking type | Per adult | Per child |
|---|---|---|
| Domestic and Inbound | INR 3,000 + GST | INR 1,500 + GST |
| Outbound (international) | INR 5,000 + GST | INR 2,000 + GST |
GST is payable on the service/handling charge at the applicable rate. The balance of the amount you have paid is refunded under Clause 4.7, after deducting any payment gateway charges actually incurred (Clause 3.7(b)). Any TCS collected is shown separately and dealt with under Clause 4.6.
Example (for illustration only). A Domestic Booking for 2 adults and 1 child; advance paid INR 80,000; no part of the advance yet paid to any supplier/hotel. Service/handling charge = (2 × INR 3,000) + (1 × INR 1,500) = INR 7,500, plus GST on INR 7,500. Refund = INR 80,000 − INR 7,500 − GST on INR 7,500 − any gateway charge actually incurred (Clause 3.7(b)).
Where any part of the advance has already been paid to suppliers/hotels, the cancellation charges in Clause 4.3 (applied as explained in that Clause) apply instead, and the handling fee is included within the limit in that Clause rather than deducted separately. The service/handling charge is not deducted where the cancellation is made by us or by a supplier/hotel for reasons not caused by you, except as provided in Clause 5.3.
4.4 Tour- and supplier/hotel-specific conditions. Certain tours, Services and suppliers/hotels have their own booking, payment, cancellation and refund conditions (for example peak season and holiday periods, festival or event dates, cruises, special trains, charter flights, wildlife safaris, adventure activities and promotional or non-refundable rates). Where such conditions apply, they supersede the general booking, payment, cancellation and refund conditions in these Terms for that tour or Service. The applicable conditions will be set out in the Quotation or confirmed in writing before you make the initial advance payment. Non-refundable conditions for any Service will be disclosed to you before you make a payment for that Service. Conditions not disclosed to you in this way will not be applied to you in place of these Terms.
4.5 Non-refundable Services. Unless otherwise stated in the Quotation, the following are non-refundable once booked or paid, irrespective of the cancellation date, to the extent the relevant supplier/hotel does not refund them to us. Where a supplier/hotel does make a refund, we will pass it on under Clause 4.7(b).
- (a) flight tickets booked under non-refundable fares, and airline cancellation/re-issue fees under refundable fares (airline fare rules apply; only statutory taxes/fees refundable by the airline will be refunded);
- (b) wildlife safari permits, park entry and jungle/canter/jeep bookings, which are generally non-refundable and non-transferable under forest/park authority rules;
- (c) cruise fares, which are subject to the cruise line's cancellation schedule and are often fully non-refundable close to sailing;
- (d) peak season, festive and holiday period bookings (for example Christmas–New Year, Diwali, Holi, long weekends, local festivals and major events), including compulsory gala dinners and minimum-stay supplements;
- (e) promotional, early-bird and "non-refundable rate" hotel bookings;
- (f) visa fees, VFS/service charges and visa facilitation charges, whether or not the visa is granted;
- (g) travel insurance premiums, which are refundable only under the policy terms and applicable law (see Clause 8.2);
- (h) event, concert, sports, theme park and attraction tickets;
- (i) payment gateway/convenience charges actually incurred and bank charges (see Clause 3.7);
- (j) Indian Holidays' service fee for visa, documentation or similar standalone services already performed.
4.6 Taxes on cancellation. Taxes charged on a cancelled Booking will be adjusted, refunded or credited in accordance with the tax laws in force, and we will issue any credit note or revised invoice required by law. TCS collected for a cancelled outbound package will be dealt with as permitted under income-tax law; TCS is shown separately in your refund statement, is not part of any cancellation or service/handling charge, and we will tell you how it has been dealt with.
4.7 Refunds – calculation and timing. When a cancellation takes effect, we will send you a written refund statement showing the amounts you paid (with any TCS shown separately), any Indian Holidays charges, any supplier/hotel cancellation charges or non-refundable amounts, any gateway or bank charges actually incurred, any amounts still awaited from suppliers/hotels, and the refund due. After deducting applicable charges and non-refundable amounts, we will process any refund due:
- (a) for amounts held by Indian Holidays, within 15 working days of the cancellation taking effect; and
- (b) for amounts already paid to suppliers/hotels, within 15 working days of our actual receipt of the refund from the relevant supplier/hotel. We can process a refund that depends on a supplier/hotel refund only after we have received that refund and matched it to your Booking. We will take reasonable steps to pursue supplier/hotel refunds, will tell you the supplier's expected refund timeline where we know it, and will keep you informed of their status on request.
What the refund timelines cover. The 15 working days in (a) and (b) is the time Indian Holidays takes to process and send the refund. It does not include: (i) the time a supplier/hotel takes to refund us, where your refund depends on that supplier/hotel refund; or (ii) the time your bank, card issuer or payment provider takes to credit the refund to you after we have sent it. We will tell you if we expect a material delay at any stage, with the reason and the expected timing. Nothing in this Clause extends any time limit for refunds that applies under law.
4.8 Refunds – mode and currency. Refunds will be made to the same account/instrument from which payment was received, in Indian Rupees. Exchange-rate differences between the dates of payment and refund, and bank/gateway charges already incurred, are not refundable. Where a supplier/hotel issues a credit note or voucher instead of a cash refund, we will pass it on to you and inform you of its conditions, and where the supplier/hotel offers a choice between a refund and a credit, we will ask you which you prefer. Amounts held by Indian Holidays that are refundable will be refunded in money, and not as a credit, unless you agree otherwise in writing.
4.9 No-show and late arrival. Failure to arrive for any Service on the scheduled date and time (a "no-show"), or to join a tour, is treated as a cancellation with 100% charges for that Service. Missing a Service because of late arrival, missed connections not booked by us, lack of valid travel documents, or denied boarding/entry for reasons attributable to you, is treated as a no-show.
4.10 Amendments by you. We will try to accommodate requested changes (dates, hotels, room types, itinerary). Each amendment is subject to availability and supplier/hotel conditions, and may attract:
- (a) supplier/hotel amendment or cancellation charges and any fare/rate difference; and
- (b) an Indian Holidays amendment fee per amendment, as stated in the Quotation, plus GST.
A significant change requested within 30 days of the Date of Arrival (for example change of travel dates or destination) may be treated as a cancellation of the original Booking and a new Booking. We will tell you the charges that would apply before you confirm the change.
4.11 Name changes and substitutions. Where a traveller cannot travel, you may ask to transfer their place to another person. This is possible only where suppliers/hotels permit it. Airline tickets are generally non-transferable and name changes usually require cancellation and re-issue at prevailing fares. You and the substitute are jointly responsible for any charges.
4.12 Partial cancellation. If some travellers in a Booking cancel, cancellation charges apply to their share, and the remaining travellers must pay any resulting increase in per-person costs (for example single-room supplements or vehicle cost sharing). We will tell you the revised cost in writing.
4.13 Cancellation by Indian Holidays or a supplier/hotel. We may cancel a Booking:
- (a) for non-payment in accordance with Clause 3.5 (in which case Clause 4.3 applies); or
- (b) if a supplier/hotel cancels, or for safety reasons. In that case we will offer you a comparable alternative or a full refund of all amounts paid to us for the cancelled Services, less only amounts that we are unable to recover from suppliers/hotels for reasons outside our control, which we will pass on as and when recovered. We will not deduct our own service/handling charges in this case, and payment gateway charges are dealt with under Clause 3.7(b). Clause 5.3 applies to Force Majeure Events; or
- (c) if a group tour does not reach its minimum group size. Where a group tour requires a minimum number of travellers (as stated in the Quotation) and we cancel it solely because that minimum has not been reached, we aim to tell you at least 21 days before departure wherever reasonably practicable; if the decision cannot reasonably be made that early, we will tell you as soon as it is made. We will first offer you an alternative departure date or a suitable alternative tour, explaining any price difference before you accept. If you decline the alternative, we will refund in full all amounts received from you for the cancelled tour, including any payment gateway charges, without deducting any cancellation charge, service/handling charge or amount we cannot recover from suppliers/hotels, subject to applicable law, within the time in Clause 4.7(a). A cancellation under this paragraph (c) is a cancellation by us; it is not a cancellation by you, and Clauses 4.3 and 4.3A do not apply to it.
5. Itinerary Changes, Force Majeure & Unused Services
5.1 Significant changes before departure. Itineraries are planned in good faith but may need to change. If we or a supplier/hotel need to make a significant change before departure (for example change of destination, a substantial change of travel dates, downgrade of accommodation, or a Service that cannot be confirmed or operated and forms a significant part of the Booking), we will inform you promptly, explain the change and any effect on the price, tell you the time within which you need to choose (taking account of supplier/hotel deadlines), and you may:
- (a) accept the change (with a refund of any price difference if the alternative is cheaper);
- (b) accept a comparable alternative we offer; or
- (c) cancel the affected Services and receive a refund of amounts paid for them, less amounts already irrecoverably paid to suppliers/hotels where the change results from a Force Majeure Event (see Clause 5.3.3).
Where the significant change does not result from a Force Majeure Event and is not caused by you, the refund under (c) is a full refund of the amounts paid for the affected Services, and no cancellation charges or service/handling charges apply. A material price increase is dealt with under Clause 2.7.
Minor changes (for example change of hotel to one of a similar standard, change in order of sightseeing, flight timing changes by airlines) may be made without liability. We will tell you of minor changes as soon as reasonably practicable.
5.2 Changes during travel. During travel, we, our local representatives, drivers, guides or suppliers/hotels may alter the itinerary, routes, timings or accommodation where reasonably necessary because of weather, road, traffic or safety conditions, government orders, closures of monuments/parks, or other operational reasons. We will use reasonable endeavours to provide comparable alternatives and, where practicable, will discuss them with you before additional costs are incurred. Additional costs caused by events beyond our control (for example extra hotel nights due to landslides or flight cancellations) are payable by the Client, and we will assist you in claiming any amounts recoverable from suppliers/hotels or insurers. Where a change is needed because of our own failure, we will bear the resulting additional costs.
5.3 Force Majeure & Client Self-Determination / Informed Decision
5.3.1. Unforeseen Events (Force Majeure): The Company shall not be liable for any failure, delay, alteration, or cancellation of performance under this agreement resulting directly or indirectly from acts of God, natural disasters, floods, earthquakes, landslides, severe weather events, epidemics, pandemics, civil unrest, riots, war, strikes, curfews, political upheaval, or government restrictions/advisories ("Force Majeure Events").
5.3.2. Client Informed Choice & Assumption of Risk: In the event of an impending or ongoing Force Majeure Event prior to or during the tour, the client acknowledges and agrees that:
a) The decision to proceed with, alter, or abort the journey shall rest solely with the client based on their own independent assessment of local conditions, government travel advisories, and personal safety preferences.
b) The Company may provide local situational updates or advisories purely for guidance; however, such information does not constitute legal, safety, or medical advice.
c) By electing to continue travel or proceed with the itinerary during or following a Force Majeure Event, the client explicitly assumes all associated operational, personal, health, and financial risks.
5.3.3. Financial Liabilities & Refund Limitation: If travel is disrupted, modified, or canceled due to a Force Majeure Event or as a result of the client's voluntary decision to abandon or modify the tour:
a) The Company shall not be liable for any compensatory damages, consequential losses, additional accommodation/re-routing costs, or out-of-pocket expenses incurred by the client.
b) Refunds, if any, shall strictly be subject to the recovery of funds from third-party suppliers (airlines, hotels, local transport vendors) after deducting reasonable administrative costs incurred by the Company.
5.4 Options when a Service cannot operate, and statutory position. Where a Force Majeure Event or other event outside our control means that a supplier/hotel or Service cannot operate as booked, we will tell you promptly what options are available, which may include:
- (a) alternative arrangements of a similar standard, or a postponement to new dates, subject to availability and any price difference, which we will tell you before you accept;
- (b) credit notes or vouchers issued by suppliers/hotels, which we will pass on to you with their conditions (including validity period); and
- (c) a refund of amounts we hold that have not been paid to suppliers/hotels and of amounts we recover from suppliers/hotels, in each case in accordance with Clause 5.3.3(b), with a written statement under Clause 4.7.
Amounts that are genuinely non-refundable are those that the supplier/hotel retains under its disclosed conditions and does not refund or credit to us; we will identify them in the refund statement. Clause 5.3 is to be read consistently with section 56 of the Indian Contract Act, 1872 (frustration) and Clause 7.7.
5.5 Unused Services. No refund will be made for Services that are offered but not used by you (for example meals, sightseeing, transfers or hotel nights not used, early departure or late joining), whether voluntarily or because of illness, personal reasons or your own conduct. Where a supplier/hotel gives a refund for an unused Service, we will pass it on to you, less applicable bank charges.
5.6 Flight schedule changes. Airlines may change schedules, cancel or reroute flights. These are governed by airline conditions of carriage and applicable aviation regulations. We will assist you, but airline obligations (refunds, compensation, rebooking) remain those of the airline. Consequential costs (for example missed hotel nights or connections) are not our liability unless caused by our own error.
6. Client Responsibilities
6.1 Passports. For international travel, each traveller must hold a valid passport that meets the requirements of each country to be visited or transited. Many countries require at least six (6) months' validity beyond the date of return or departure from that country, and some require longer (for example nine (9) months), as well as a minimum number of blank pages. We will tell you of the passport requirements we are aware of for your destination, but requirements change and you must check them with the relevant embassy/high commission before travel. This applies to Outbound travel and to Inbound travellers entering India, who must meet India's entry requirements. Damaged or mutilated passports may be refused.
6.2 Visas and entry requirements. Indian Holidays provides visa guidance and assistance only, against a service charge. This may include advice on the documents required, help with forms, appointments and submission. The grant, refusal, timing and validity of any visa is at the sole discretion of the relevant embassy, high commission, consulate or immigration authority, and we do not guarantee any outcome. Visa fees, VFS/visa centre charges and our visa service charges are non-refundable, whether the visa is granted, refused, delayed or withdrawn, or the application is cancelled. If a visa is refused or delayed, the cancellation charges in Clause 4 apply to the rest of the Booking. Obtaining the correct visa, transit visa, e-visa or entry permit remains the sole responsibility of the traveller. Visa and entry requirements differ by destination, nationality and purpose of travel. For Outbound travel, you must check transit, onward/return ticket and entry requirements for each country (for example vaccination certificates, travel insurance, proof of funds and accommodation). For Inbound travel, foreign nationals must hold a valid Indian visa or e-visa and any Protected/Restricted Area Permit required for the regions visited.
6.3 Inner Line Permits / Protected and Restricted Area Permits. Certain areas in India (including parts of the North-East, Ladakh, Sikkim, the Andaman & Nicobar Islands and border areas) require Inner Line Permits (ILP), Protected Area Permits (PAP) or Restricted Area Permits (RAP), particularly for foreign nationals. You must provide accurate documents and identity proofs in time for permits to be applied for. Permit rules can change at short notice, and certain areas may be closed to some nationalities. We are not liable if a permit is refused, delayed or revoked by the authorities.
6.4 Identity documents and hotel policies. Each traveller must carry valid government-issued photo identification (and, for foreign nationals, passport and visa) for flights, hotels, permits and checkpoints. Hotel identity and admission policies vary by property and destination (for example, some hotels do not accept local residents or require particular documents for couples or minors). We will tell you of such policies that we are aware of before you pay the initial advance. Where a hotel refuses check-in because a traveller does not meet its policy, the hotel's charges will apply.
6.5 Documents for tax compliance. For outbound packages, you must provide PAN and any declarations or documents required by law (see Clauses 2.3–2.5) before we can issue invoices and make remittances.
6.6 Health, fitness and declarations.
- (a) You must ensure that each traveller is medically fit to undertake the travel and the activities booked, including high altitude travel (for example Ladakh, Spiti, Sikkim, Bhutan, Nepal, Tibet), trekking, water sports, safaris and long road journeys.
- (b) Please tell us in writing, before booking, about any medical condition, disability, pregnancy, allergy, dietary restriction or mobility limitation that may affect travel or require special arrangements. You need only share the information required for the arrangements; please do not send medical records through our website enquiry form. We will try to accommodate needs but cannot guarantee them.
- (c) Some suppliers/hotels and activity operators may require a medical certificate or signed health declaration, and may refuse participation to anyone they consider unfit, without refund.
- (d) You are responsible for vaccinations, health certificates and medicines required for the destination, and for consulting a doctor about altitude sickness and other health risks.
6.7 Conduct. Travellers must behave responsibly and respect local laws, customs, religious sites, wildlife and the environment. We or any supplier/hotel may terminate the Services of any traveller whose behaviour is unlawful, abusive, dangerous or disruptive, without refund, and the traveller will be liable for any damage, loss or costs caused (including damage to hotel rooms or vehicles).
6.8 Local laws. Travellers must comply with the laws of India and of each country visited, including laws on drugs, alcohol, photography of restricted sites, wildlife products, currency and customs declarations, drones and dress codes. We are not liable for consequences of any breach of law by a traveller.
6.9 Check-in, reporting and departure times. You must reach airports, stations, ports, hotels and meeting points at the reporting times advised (generally at least 2 hours before domestic flights and 3 hours before international flights, or as advised by the airline). Missed Services due to late reporting are treated as no-shows.
6.9A Pickup and drop timings for transfers and sightseeing. Drivers, guides and coach operators work to a fixed schedule, often with other guests to collect. We kindly ask you to be ready at the pickup point at the time given by us or the supplier, for all transfers and sightseeing. If you are not there on time, the vehicle may have to leave after a reasonable wait, so that other guests and the day's schedule are not affected. In that case, you will need to make your own arrangements to reach the destination or join the tour, at your own cost, and the missed Service will be treated as used. If you are running late, please call the driver, guide or our helpline (+91 98100 74368) as early as possible, and we will try to help wherever we can.
6.10 Baggage and valuables. Baggage and personal belongings are at the traveller's risk throughout the tour. Baggage allowances are set by airlines and transport operators. Do not leave valuables in vehicles or unattended; use hotel safes.
6.11 Travel with minors.
- (a) Minors (under 18) must travel with a parent or legal guardian, or with an adult authorised in writing by the parent(s)/guardian(s).
- (b) Where a minor travels with one parent or a non-parent adult, the traveller must carry any consent letter, birth certificate or other documents required by immigration authorities, airlines and hotels. Requirements differ between countries and we will not be liable for denied boarding or entry.
- (c) Parents/guardians remain fully responsible for the supervision, safety and conduct of minors at all times, including during activities and at swimming pools/beaches.
- (d) Child pricing depends on the age at the date of travel and on supplier/hotel policy; proof of age may be requested.
6.12 Information accuracy. You must provide complete and accurate information. We are not liable for losses caused by inaccurate, incomplete or late information provided by you.
7. Our Responsibilities and Limitation of Liability
7.1 Third-party suppliers/hotels. Airlines, hotels, cab and coach operators, cruise lines, houseboat/shikara operators, safari and adventure operators, guides and other suppliers/hotels are independent contractors and are not agents or employees of Indian Holidays. They are responsible for the delivery, quality, safety and standards of their own Services, and their own acts and omissions.
7.2 Our responsibility. We are responsible for: (a) exercising reasonable skill and care in planning the Services and making the arrangements we have agreed to make; (b) selecting suppliers/hotels with reasonable care; (c) providing information we have about the Services accurately; (d) passing your payments to suppliers/hotels as needed to secure the confirmed Services; (e) telling you promptly of changes, cancellations and price changes that we are told about; and (f) handling cancellations and refunds in accordance with these Terms. Except to the extent caused by our own negligence, deficiency in service or breach of these Terms, we are not liable for any act, omission, negligence, default, delay, injury, loss, damage, accident, theft or deficiency caused by a supplier/hotel or any other third party.
7.3 Assistance. If something goes wrong with a supplier/hotel's Service, we will provide reasonable assistance, including taking up your complaint with the supplier/hotel, helping you obtain any refund or compensation due from the supplier/hotel, and providing information and documents we hold that you need for an insurance claim (see Clause 8.2).
7.4 Excluded losses. Subject to Clause 7.7 and to the maximum extent permitted by law, we are not liable for any indirect, consequential or special loss, loss of enjoyment beyond the cost of the affected Service, loss of earnings, business loss, or loss of opportunity. Damages, if any, will be assessed in accordance with section 73 of the Indian Contract Act, 1872.
7.5 Cap on liability. Subject to Clause 7.7, our total aggregate liability for any claim relating to a Service shall not exceed the amount actually received by Indian Holidays for the specific Service affected (excluding taxes and TCS remitted to the Government and amounts already refunded).
7.6 International conventions and supplier limits. Where a supplier/hotel's liability is limited by international conventions (for example the Montreal Convention for international air carriage) or by law, our liability in relation to that Service, so far as it arises from the supplier/hotel's performance, shall not exceed the limits applicable to that supplier/hotel.
7.7 Non-excludable rights. Nothing in these Terms excludes or limits: (a) any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our own negligence, or for fraud; or (b) any right or remedy available to a consumer under the Consumer Protection Act, 2019 that cannot lawfully be waived.
7.8 Information and advice. Information on destinations, weather, visas, health and safety is provided in good faith for general guidance only. You should check official sources (for example the Ministry of External Affairs, embassies, and health authorities) before travel.
8. Insurance, Health & High-Risk Adventure Disclaimer
8.1 Overseas travel insurance – our recommendation. We recommend that all travellers going overseas consider suitable travel insurance. Cover may include overseas medical emergencies, hospitalisation, illness, trip cancellation, trip curtailment, baggage loss and passport loss, subject to the terms of the policy. Insurance is not a general condition of booking with Indian Holidays. Where insurance is required by the destination or visa for your journey (for example, Schengen visas for travel to Europe require travel medical insurance), you must hold it, and we will tell you of requirements we are aware of. If you choose not to buy insurance, you are responsible for costs that suitable insurance would otherwise have covered, except where we are liable for them under these Terms.
8.2 How we help you obtain a policy. Indian Holidays acts only as a facilitator for customers wishing to obtain overseas travel insurance. Indian Holidays does not provide or underwrite insurance and is not an insurance intermediary. Your policy is a contract directly between you and the insurer: you must submit any claim directly to the insurer, and claim settlements and any disputes about them are between you and the insurer. Cancellation of a policy and any premium refund are subject to the policy terms. Please check your policy details, coverage and exclusions carefully when you receive it.
Travel Insurance Disclosure
Travel assistance services are provided by Asego. Insurance is underwritten by an IRDAI-authorised insurance company. Insurance is a subject matter of solicitation. All insurance policies are sold under the Corporate Agency of Asego Insurance LLP, IRDAI Registration No. CA0776.
For details of risk factors, terms and conditions, please read the policy terms and conditions carefully before concluding a purchase.
8.3 Medical emergencies. In an emergency we will use reasonable endeavours to help you access medical care. All medical, hospital, evacuation and related costs are payable by the traveller (or their insurer). We are not responsible for the quality or availability of medical facilities at any destination, which may be limited in remote areas.
8.4 High-risk and adventure activities. Activities such as trekking, mountaineering, high-altitude travel, river rafting, paragliding, parasailing, scuba diving, snorkelling, water sports, skiing, bungee jumping, zip-lining, camel/horse/yak/elephant rides, jeep/canter safaris, desert safaris and similar activities ("Adventure Activities") carry inherent risks of serious injury, illness or death, including risks from terrain, weather, altitude, wildlife, water and equipment.
8.5 Assumption of risk. By choosing to participate in any Adventure Activity, each traveller (or their parent/guardian, for minors) voluntarily accepts the inherent risks of that activity, confirms they are fit to participate, and agrees to follow all safety instructions, briefings, age/weight/health limits and local rules of the activity operator.
8.6 Operator waivers. Adventure Activities are operated by independent operators who may require you to sign their own waiver, indemnity or declaration. Refusal to sign may result in non-participation without refund.
8.7 Waiver to the extent permitted by law. To the fullest extent permitted by law, Indian Holidays shall not be liable for injury, illness, death, loss or damage arising from the inherent risks of Adventure Activities, or from the acts or omissions of activity operators, save where caused by our own negligence. This Clause does not limit any right that cannot be excluded under Clause 7.7.
8.8 Wildlife. Wildlife sightings on safaris are never guaranteed. Safari zones, vehicles and timings are allotted by park/forest authorities and may change. Travellers must obey park rules and naturalists at all times.
8.9 High altitude. Travel to high-altitude destinations involves risk of Acute Mountain Sickness. Travellers should allow for acclimatisation, consult a doctor before travel, and follow local advisories. Itineraries may be altered for safety without liability, and Clause 5.2 applies to any resulting changes.
9. Governing Law, Dispute Resolution & Jurisdiction
9.1 Governing law. These Terms and every Booking are governed by and construed in accordance with the laws of India.
9.2 Amicable resolution first. Any dispute should first be raised through the complaints procedure in Clause 10. The parties will attempt in good faith to resolve the dispute within 30 days. This does not prevent a consumer from exercising the rights described in Clause 9.5 at any time.
9.3 Arbitration. If the dispute is not resolved amicably, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement (failing which, in accordance with the Act). The seat and venue of arbitration shall be Gurugram, Haryana, and the language shall be English. The award shall be final and binding. For consumers, this Clause 9.3 applies only as stated in Clause 9.5.
9.4 Jurisdiction. Subject to Clauses 9.3 and 9.5, the courts at Gurugram, Haryana shall have exclusive jurisdiction over all matters arising out of or in connection with these Terms or any Booking, including applications relating to the arbitration.
9.5 Consumer rights preserved. Nothing in this Clause 9 limits the statutory right of a consumer to file a complaint before the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, including a Commission having jurisdiction where the consumer resides or works as permitted by that Act, or to approach the National Consumer Helpline. The arbitration clause applies to consumer disputes only if the consumer elects to proceed by arbitration after the dispute has arisen.
10. Complaints and Grievance Redressal
10.1 During travel. If you have a problem during your trip, please tell the supplier/hotel and our representative/helpline immediately (+91 98100 74368) so that we have a fair opportunity to resolve it on the spot. Failure to report a problem during travel may reduce any compensation where an on-the-spot solution was possible.
10.2 After travel. Complaints should be sent in writing to us at bookings@indianholidaystours.com, preferably within 30 days after the end of the trip, with the Booking reference, details of the issue and supporting documents/photos. Raising a complaint promptly helps us investigate it with the supplier/hotel; complaints received later will still be considered, and this time frame does not affect any time limit or right available to you under law.
10.3 Contact for complaints. Complaints are handled by Rajeev Sobti, Proprietor, Indian Holidays, who is also our designated Grievance Officer (see our Privacy Policy, Section 11), Tower-10-001, Emerald Floors Premier, Sector-65, Gurugram-122101, Haryana; Email: bookings@indianholidaystours.com; Phone: +91 98100 74368.
10.4 Timelines. We will acknowledge your complaint within 48 hours and aim to resolve it within one (1) month of receipt. If your complaint is not resolved within that time (for example, because we are waiting for a supplier/hotel's response), we will update you on progress, explain the reason for the delay and tell you the next steps. We will send you our response in writing. This does not affect your statutory rights and remedies (see Clauses 9.5 and 10.5). Grievances about how we handle your personal data are dealt with under our Privacy Policy (Section 11), which provides for their redress within one month of receipt.
10.5 Escalation. If you are not satisfied with our response, you may ask for your complaint to be reviewed again personally by the Proprietor (in writing to the contact details in Clause 10.3), or you may approach the National Consumer Helpline (1915 / consumerhelpline.gov.in) or the appropriate Consumer Commission.
11. Privacy and Personal Data
11.1 Applicable law. We process personal data in accordance with applicable Indian law, including the Information Technology Act, 2000 and rules under it, and the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025 as their provisions come into force.
11.2 Data we collect. Names, contact details, dates of birth, nationality, passport/visa/ID details, PAN (where required), payment details, travel preferences, dietary and health information you choose to share, and emergency contacts. We ask for passport, PAN, health or similar sensitive details only when they are needed for a Booking. We will tell you why they are needed, how they will be used and how to send them to us (which may be by email or WhatsApp); please do not send them through our website enquiry form.
11.3 Purposes. To quote for, book and deliver the Services; to apply for visas and permits; where you ask us to facilitate an overseas travel insurance policy, to share the details needed for it with Asego Insurance LLP and the insurer; to comply with legal obligations (including tax, foreign exchange, hotel guest registration, Form C for foreign nationals, and law-enforcement requests); for safety and emergency assistance; for complaint handling; and, with your separate consent, for marketing.
11.4 Sharing. Your data will be shared, to the extent necessary to respond to you, process payments, make bookings and deliver the Services, or as required by law, with: airlines, hotels, destination management companies (DMCs), cruise operators and other travel suppliers; WhatsApp and email service providers that we use to communicate with you; online payment gateways; embassies/consulates, visa centres and permit authorities (where you use our visa or permit assistance); Asego Insurance LLP (corporate agent) and the insurer (only where you ask us to facilitate a travel insurance policy); and government authorities where required by law, including transfers outside India for international travel (subject to any restrictions notified by the Government).
11.5 Consent and your rights. We process personal data with your consent or as otherwise permitted by law (for example, to perform your Booking or to comply with legal requirements). When you share the personal data of other travellers, you confirm that you are authorised to do so and that you have told them about this Clause. Subject to applicable law, you may request access to a summary of your data, correction, completion, updating or erasure (subject to legal retention requirements), and grievance redressal; nominate a person to exercise rights on your behalf; and withdraw consent at any time by writing to bookings@indianholidaystours.com. Our Privacy Policy explains how to make a request and how we handle it. Withdrawal does not affect processing already done or processing required by law or to perform the Booking, but if you withdraw consent needed for the Booking we may be unable to continue with it.
11.6 Retention and security. The retention periods are set out in our Privacy Policy (Section 7). In summary, we keep booking confirmations, invoices, payment records, relevant correspondence and supporting business records for the periods required by applicable law (for example tax law) and for documented business needs such as audits, tax assessments, government scrutiny, legal compliance and official enquiries. We delete copies of passports, visas and health documents within 90 days after completion of the trip, unless a pending claim, complaint, dispute, legal obligation or other documented legitimate need requires longer; unconverted enquiries are kept for up to 24 months and complaints for 3 years after closure (these are our own retention periods, not statutory deadlines). Access to personal data is restricted to authorised personnel who need it, and we take appropriate safeguards against unauthorised access, disclosure, loss or misuse. Children's data is collected from a parent or lawful guardian, and we will obtain any parental consent required by law.
11.7 Privacy Policy. Further details are in our Privacy Policy, available on our website (https://indianholidaystours.com – see the Privacy Policy link in the website footer) or on request.
12. Photographs and Marketing Consent
12.1 We or our representatives may take photographs or videos during group tours or events. We will use identifiable images of you in marketing (website, social media, brochures) only with your prior consent, which you may give or refuse when booking and withdraw at any time for future use.
12.2 If you share reviews, photographs or videos with us or tag us on social media, you grant us a non-exclusive, royalty-free licence to reproduce them with credit for promotional purposes, unless you tell us otherwise. You may ask us at any time to stop using them for future promotion. Images of minors will not be used without parental/guardian consent.
12.3 You agree to post only genuine reviews, and we will publish reviews in accordance with applicable consumer law and standards on online reviews.
13. General Provisions
13.1 Severability. If any provision of these Terms is held invalid, unfair or unenforceable by any court, tribunal or Consumer Commission, it shall be read down or severed to the minimum extent necessary, and the remaining provisions shall continue in full force.
13.2 Entire agreement. These Terms, together with the Quotation, Booking confirmation and the disclosed tour- and supplier/hotel-specific conditions, form the entire agreement between you and Indian Holidays for the Booking and supersede earlier discussions. Nothing in this clause excludes liability for fraudulent misrepresentation.
13.3 Amendments. We may update these Terms from time to time. The version in force on the date of your Booking confirmation applies to that Booking, except for changes required by law. The current version will be available at https://indianholidaystours.com.
13.4 Notices. Notices to us must be sent to bookings@indianholidaystours.com and/or by post/courier to our address above. Notices to you will be sent to the email address, phone/WhatsApp number or postal address you provided. Email notices are treated as received on the same working day if sent before 6:00 PM IST, otherwise on the next working day.
13.5 Waiver. Failure or delay in enforcing any right is not a waiver of that right.
13.6 Assignment. You may not transfer a Booking except as allowed under Clause 4.11. We may subcontract the performance of Services to suppliers/hotels.
13.7 Language. These Terms are in English. Any translation is for convenience only and the English version prevails.
13.8 Survival. Clauses on payment, cancellation and refunds, liability, privacy, and dispute resolution survive the completion or cancellation of a Booking.
